Terms and conditions for using our website or listing on our website

Definitions:

“Member” means somebody who subscribes to our services to list their information;

“Services” means the listing of information, the hosting of our website and the search functionality we provide;

“User” means anybody using our website whether or not they are also a member;

“Website” means (www.trustedlocalelectrician.co.uk);

“We”, “us”, “our” describes the business that trades as “Trusted Local Electrician”; Contact: Info@trustedlocalelectrician.co.uk

“You” means the person using our website [www.trustedlocalelectrician.co.uk] and if appropriate listing on our website, and this will be you personally even if they are using or listing on behalf of a company or third party.

Agreement:

This is a contract which governs our relations with both persons visiting our Website and listing on our Website.

People using our Website are not liable to pay any subscription or listing fees as set out under the “Member Agreement” section below but are subject to other terms of use.

All persons using our Website agree that by listing on our site, accessing or using the website or any of our Services, you are agreeing to enter into a legally binding contract with us.

This agreement will be between us and you personally (even if you are using our services on behalf of a company or for a third party).

If you do not agree to this contract (also “Contract” or “User Agreement”), do not sign up, do not list as member or otherwise use our website or any of our Services.

If you wish to terminate this contract at any time you can do so by giving us notice in writing to close your account and thereafter by no longer accessing or using our site or Services.

We reserve the right to update or amend these terms at any time and your continued use of the Website and/or Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the terms regularly for any changes.

We will not change the subscription prices for Members without writing directly to Members to give explicit notice and to seek their consent.

Member Agreement:

We agree to list member information for Members by supplying the Services listed below in exchange for a monthly subscription fee of £4.99 per calendar month. That fee is payable by direct debit. There is no minimum or maximum subscription period.

You may terminate your membership and cancel your subscription at any time by stopping your direct debit payment and giving us written notice of your cancellation.

We may also terminate at any time by ceasing to take payment and/or ceasing to list your details and/or by giving you written notice.

We will not take payment for any period when we do not supply the Services and/or list your details by making them available for some or all of that period on our Website.

In accordance with our privacy policy below, once your membership is terminated, we may remove or permanently delete your details, but we are not required to do so.

Set up fee: in addition to the monthly subscription for members, there is a one off set up fee of £19.99.

The Services we provide:

We will check each electrician who seeks to list on our website at the time they list to ensure that they are accredited by being listed with a government-approved trade body and in particular: NICEIC, NAPIT, STROMA, OFTEC, ELECSA, BSI, BESCA and Benchmark. Typically, by being accredited an electrician has provided proof of their identity and has the requisite qualifications or experience to satisfy such trade body of their competence. However we cannot guarantee the accuracy of the information supplied to and accepted by such trade bodies. We may also (but are not obliged to) require up to date proof that such members continue to be accredited after they have listed with us.  

We will also check that any member listing has insurance at the time when they list. Typically we expect to see £2 million in public liability insurance and we may (but are not obliged to) publish such details.  We may also (but are not obliged to) require up to date proof of renewals.

We may make enquiries of the above said government-approved trade bodies of any member listing for the prevention of fraud or if we otherwise consider it necessary or appropriate to check or verify their identification, qualifications and credentials. Often such bodies will share information for the purposes of preventing fraud, but we cannot guarantee that information will be made available to us. Whether we make such enquiries is also a matter in our sole, unfettered discretion.

We may (but are not obliged to) collect feedback on electricians and/or seek recommendations from customers to enhance our listing Services.

Please note that unless we clearly notify you to the contrary and in writing, the electricians listed on our website are entirely independent of us, and it is not ourselves that provide any of the electrician services marketed on this Website. The electricians listed are also not our employees, agents or partners.  

Our privacy notice sets out the terms on which we process any personal data we collect from you or that you provide to us (“Privacy Notice”). The Privacy Notice also sets out who we share the content you upload or provide with;

The Website:

We do not guarantee that the Website or any content contained on the Website will always be available or be uninterrupted.

We cannot guarantee that the Website will be secure or free from bugs or viruses.

You are responsible for making all arrangements necessary for you to have access to the Website and that you have up to date and functioning virus protection.

Members are responsible for the contents they chose to list. We may redact or make changes reasonably required for formatting or presentation purposes but we will endeavour to agree these with you and not to change the material substance of any information supplied for listing.

Your access to the Website and listing of details is temporary. We may suspend, withdraw, discontinue or change all or any part of the Website without notice to you.

We will not charge members for any month in which their listing details have not been accessible on our Website for at least some part of that month (one or more days in duration sufficing for such purposes).

The content of our Website is provided for general information only. It is not intended to amount to advice on which you should rely.

Although we endeavour to update the information on the Website, please note that the content contained on the Website may be out of date at any given time and we are under no obligation to update it.

Disclaimer, limitation of liability and exclusions:

We cannot be held responsible for any work carried out or goods supplied by the electricians listed on our website. They are not us our agents, employees or partners. We do not control their prices or availability, or competence or suitability.

You agree to hold us blameless and to waive and disclaim any claim you may have arising out of any fault for anything done or not done by any electrician listed on this website. In particular (without limitation):

We are not responsible for response times and will not be liable for the failure of any member to succeed in providing any service in any specific time quoted.

Any pricing information displayed is offered by the electrician and is not offered or guaranteed by us. Any agreement reached between you and a member is a contract between you and that member and accordingly we are not a party to it.

Whilst we request copies of public liability insurance from our members and will ask when it expires we cannot guarantee our members retain such insurance or that we will be able to monitor that it is up to date and you should always ask for confirmation of up to date insurance from any electrician you book and cannot hold us liable for any failure to monitor that information.

The information we list is based on information supplied by various individuals and businesses, and it does not represent our views and we cannot be held responsible for any omissions or inaccurate claims that may appear.

We makes no warranty that the Website or Services will meet your requirements, that the details listed will be accurate or reliable, that the functionality of the Website or our Services will be uninterrupted or error free, that defects will be corrected or that the Website or our Services or the server that makes them available are free of viruses or anything else that may be harmful or destructive.

We will not be liable to you for any loss suffered (even if such loss is foreseeable) in relation to your use or inability to use the Website, any inaccuracies or delays on the Website or any reliance by you on content contained on the Website.

You agree that we do not represent, or make any warranty or guarantee over the quality, timing, integrity, responsibility, legality or any other aspect whatsoever of the materials or services offered or delivered by its members to their customers.

Use of the Website and our Services is at your own risk. The Website and Services are provided without any representation or warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

We are not responsible nor can we be held liable to any third party for the contents, or accuracy of any content uploaded to our Website by members or by us based upon information supplied by members.

We will not be liable to you for any reason if the Website is unavailable at any time or for any period.

We will not be liable for any losses suffered through any fault, defect, or design flaw of our search functionality or for the details listed by members.

Whilst we will endeavour to prevent malicious software or viruses from spreading, we cannot guarantee that our Website will be free from the same. We will not be liable for any loss or damage caused by any virus, or any other harmful material that may infect your equipment, data, programs or other proprietary material due to your use of the Website or to your downloading of any content on the Website, or linked to the Website.

To the extent permitted by law, we will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website/Services.

In any case, we will not be liable for any consequential or business losses.

In any case, our liability to any member will be limited so as not to exceed half of the amount paid to us by that member – save as otherwise provided in this section of these terms.

Our liability to our website users will be limited so as not to exceed the sum of £100– save as otherwise provided in this section of these terms.

Nothing in these terms shall be construed so as to exclude or limit our liability for death or personal injury as a result of our negligence or that of our employees or agents.

Intellectual Property Rights:

The Website and its content (including without limitation the design, text, graphics and all software and source codes connected with it and the Services) are protected by copyright, trademarks, and other intellectual property rights and laws.

In accessing the Website you agree that you will access the contents solely for your personal, non-commercial use or if for commercial use then for the purpose of retaining an electrician for their services.

Save for the uses permitted in the sub-paragraph immediately above you agree not to download, copy, reproduce, transmit, store, sell or distribute without our prior written consent any of the contents of this website.

When you upload any content (including text or photographs) to the Website, you assign all rights in such content to us.

You agree to us using the name you submit in connection with the content you upload.

You agree that once you have submitted content, the content will become our property and you cannot recall any part of such content. In accordance with our privacy policy however we will endeavour to meet any reasonable requests to delete data you may make.

We reserves the right to edit content you upload to amend spelling, grammar, punctuation, length, for the purposes of clarity and to ensure that the content can comply with our terms and conditions including those regulating uploading content.

Prohibited use: you agree to use the Website for lawful purposes only. In particular (but without limitation) you agree that you (or somebody acting for you) will not make any use:

in a way that is unlawful or fraudulent, or has any unlawful or fraudulent object or effect;

in any way that breaches any applicable local, national or international law or regulation;

which, if used abroad, fails to comply with all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the Internet;

for the purposes of harming or attempting to harm any person, business or entity in anyway;

that undermines the purpose and provision of Services or competes with the Services;

that gains any unlawful competitive advantage over any businesses in your sector;

that violates the privacy of others;

that transmits, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of solicitation;

that reproduces, duplicates, copies, broadcasts, distributes, sells, re-brands or re-sells any part of the Website;

that reverse engineers, decompiles, dissembles, deciphers or otherwise derives the code used on the Website;

of any robot, spider, scraper, or other automated means to access the Website;

Member listings:

if/ when uploading any content you confirm you are over the age of 18 and you are permitted to upload content;

If /when uploading content, you agree you will ensure:

it is accurate, true, up to date, genuine, not misleading, relevant and appropriate

it complies with applicable law in England and Wales and in any country from which the content is posted or viewed

it does not promote illegal activity

it complies with our Privacy Notice

it does not disclose any personal or confidential information

it does not contain material which is or potentially could be defamatory, obscene, aggressive, offensive, hateful, inflammatory or rude,

it does not infringe the copyright or any intellectual property rights of any person and where such content relates to an image, you must ensure that all necessary consents and authorisations have been obtained;

it does not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

it does not represent or relate to the Services provided by us or give the impression that the information emanates from us (if this is not the case);

it does not have the purpose or effect of advertising, discussing or commenting on any third party businesses;

it is not threatening, abusive or invades others privacy or causes annoyance, inconvenience or needless anxiety;

it does not impersonate any person or misrepresent identities or affiliations.

You agree to keep your listed information up to date. You will notify us if you are no longer accredited or if you are no longer insured. You will verify your details with us, if called upon.

Indemnity:

you agree to indemnify and hold us and our employees and agents harmless from and against any breach by you of these terms and any claim or demand brought against us by any third party arising out of your use of the Services and/or any content submitted, posted or transmitted through the Services, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by us in consequence of your breach of these terms

You warrant that all content you upload complies with the above terms, and you agree to indemnify us for any loss we suffer as a result of your failure to comply with our terms including those relating to uploading content

You agree to indemnify us for and against any losses (including legal costs) arising out of the information you supply to us being or becoming inaccurate or misleading.

Termination:

You may terminate this agreement at any time by giving us notice and if a member by terminating your direct debit mandate.

We may also terminate the agreement at any time by giving you notice and/or by removing any listing you have with us and/or by not taking any payment by direct debit.

We will not charge members for any subscription period during which we do not provide any services or during which your details have not been listed by which it meant available to access on our website for at least part of the period, that being at least one or more days.

If we consider that you have breached any of the terms, we may:

withdraw your access to the Website permanently or temporarily;

sue you by brining legal proceedings against you;

and disclose necessary information to law enforcement authorities.

Severance: if any of these terms should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such term shall be severed and the remaining terms shall survive and remain in full force and effect and continue to be binding and enforceable.

Governing Law: these terms shall be governed by and construed in accordance with the law of England and Wales and you hereby submit to the exclusive jurisdiction to the courts of England and Wales.
